ORDER:

Petitioner filed this writ petition challenging the letter dated 03.10.2018 alleging theft of energy and while provisionally assessing  3,26,789/- as electricity charges with penalty, directed the petitioner to pay 50% of the assessed amount plus supervision charges and reconnection charges to restore electricity supply. 2.

During the course of hearing, learned counsel for petitioner submits that petitioner has financially constrains and requires reasonable time and instalments may be granted to him for payment of the demanded amount, but reconnection of electricity supply be provided.

Having regard to the said submission, without entering into the merits of the case, Writ Petition is disposed of, directing the petitioner to pay 25% of the provisionally assessed amount. On payment of 25% of the provisionally assessed amount, electricity connection shall be restored immediately without any delay. Petitioner shall pay balance of 25% of the provisionally assessed amount within a period of six weeks. If petitioner fails to pay the balance amount, respondents shall disconnect the electricity supply without any further notice to the petitioner. This order does not come in the way of respondents in taking further course of action as warranted by Section 154 of the Electricity Act. Subject to payment of 50% of the amount as demanded, no coercive action shall be taken by the respondents till the issue is finalized by the Special Court on the allegation made in the letter dated 03.10.2018. Pending miscellaneous petitions shall stand closed.
