THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T APPEAL No.1952 of 2017 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) The Telangana State Road Transport Corporation (TSRTC) and its Depot Manager at Nizamabad-II Depot along with the Telangana State Road Transport Corporation Employees Provident Fund Trust are in appeal aggrieved by the order dated 04.07.2017 passed by a learned Judge of this Court in W.P.No.23554 of 2013. The said writ petition was filed by the respondent herein assailing their action in not paying him a sum of Rs.41,710/- towards his Provident Fund and Rs.14,084/- towards salary of 23 days unavailed earned leave, aggregating to Rs.55,794/-.

By the order under appeal, the learned Judge allowed the writ petition and directed the appellants to pay a sum of 14,084/- towards salary of 23 days unavailed earned leave with interest thereon at 9% per annum from 09.05.2010 till the date of payment. This order was passed taking into account the fact that a sum of Rs.41,710/-, which found mention in the prayer portion, had already been paid by the date of the adjudication. Sri G.Vidya Sagar, learned senior counsel appearing for Sri A.Ravi Babu, learned counsel for the appellants, would fairly state before this Court that in the light of the meagre sum involved, he advised the appellants not to pursue this appeal, for which they agreed. Learned senior counsel would therefore request the Court to close the case without going into the merits of the issue.

Accepting the same, the writ appeal is closed leaving the issue raised by the appellants for consideration as and when the occasion arises.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
