ORDER

This writ petition is filed seeking to declare the proceedings dated 25.6.2016 issued by the 3rd respondent, as arbitrary and illegal.

The petitioner was appointed as Field Assistant under Mahatma Gandhi National Rural Employment Guarantee Scheme in the year 2007, in respect of Jalluru Gram Panchayat, Pitapuram Mandal, East Godavari District. The petitioner has been discharging his duties without any complaint. However, on the complaint of a Member of Legislative Assembly, who reviewed the works of Scheme on 23.6.2016, the 3rd respondent issued proceedings on 25.6.2016 keeping the petitioner under suspension and seven days time was given to him to submit his explanation. Pursuant to the same, the petitioner submitted his explanation denying the charges before the 3rd respondent. When no action was taken thereon, the petitioner submitted a representation before the 2nd respondent, who in turn, forwarded the same to the 3rd respondent. The petitioner has also filed a representation before the 4th respondent requesting to furnish the details of the complaint made by the Member of

Legislative Assembly on 12.08.2016. The present writ petition is filed challenging the order of suspension dated 25.6.2016. Learned counsel appearing for the petitioner submits that there is no basis for initiation of proceedings against the petitioner except the complaint of the local Member of Legislative Assembly.

A perusal of the charge framed against the petitioner makes it clear that the charge is trivial in nature and it does not warrant any enquiry at all. Further, in the recent social audit, no adverse comments were made against the performance of the petitioner. However, since the impugned order is an order of suspension, this Court is not inclined to interfere with the said order. But, keeping in view the charge levelled against the petitioner, the 3rd respondent is directed to complete the enquiry within a period of four weeks from the date of receipt of a copy of this order and pass appropriate orders impartially in an objective manner.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
