HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 28378 OF 2015 ORDER:

Heard the learned Counsel appearing on either side. The petitioners are the cardholders and state that they lodged a complaint with the second respondent on 13.10.2014 complaining irregularities committed by the Fair Price Shop Dealer of Shop No. 13 of Inmulnarva village, Kothur Mandal, Mahaboobnagar District. An enquiry was ordered and the Assistant Supply officer conducted an enquiry and submitted a report. It is the case of the petitioners that several irregularities were pointed out against the 8th respondent. The 6th respondent also seized some commodities after conducting panchanama on 4.11.2014. Thereafter the authorization of the 8th respondent was suspended and a show cause notice was issued on 24.6.2015.

6-A proceedings were also initiated against the 8th respondent and thereafter confiscation of 100% of the value of the seized stock was ordered. Pursuant to the show cause notice issued by the 4th respondent, the 8th respondent submitted his explanation undertaking to run the Fair Price Shop properly. In the circumstances, the 4th respondent by order dated 30.07.2015 imposed penalty of Rs.5,000/- on the dealer/8th respondent allowing him to run the Fair Price Shop. Challenging the proceedings dated 30.07.2015 the present Writ Petition is filed.

The order passed by the 4th respondent dated 30.07.2015

is an appealable order and when the same was pointed out, the learned Counsel for the petitioners sought time to prefer an appeal against the impugned order to the 3rd respondent. In the circumstances, this Writ Petition is disposed of giving liberty to the petitioners to prefer an appeal with in fifteen days from the date of receipt of a copy of this order to the competent authority.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
