HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 17145 of 2016 ORDER:
Heard learned counsel for the petitioners, Government Pleader for Higher Education and Sri C.Sudesh Anand, learned Standing Counsel for the second respondent.
The present writ petition came to be filed with the following prayer:
"Issue writ of mandamus declaring the action of the second respondent in not affording an opportunity of personal hearing to the petitioners for the purpose of fixation of fee for the block period 2016-2017 to 2018-2019 on the ground that the petitioners have failed to freeze the online proposal ignoring the fact that the petitioners have uploaded the online data, submitted the hard copies and paid the requisite fee within the cut off as illegal, arbitrary and unconstitutional; and consequently to direct the second respondent to provide an opportunity of personal hearing to the petitioner on part with frozen institutions and to consider, process and notify the fee for the block period 2016-2017 to 2018-2019 in favour of the petitioner institution."
Learned counsel for the petitioners mainly submits that though the petitioners have submitted all the documents and paid necessary fees but the same could not be processed due to technical error. On the other hand, Sri C.Sudesh Anand, learned counsel for the second respondent submits that the request of the petitioners will be considered if the petitioners submit all the necessary documents before the second respondent committee.
Having regard to the facts and circumstances of the case and without going into the merits of the case, the writ petition is disposed of directing the petitioner to make a representation within one week from today along with all the necessary documents and the requisite fee before the committee, in which event, the second respondent shall dispose of the same in accordance with law, by directing the petitioner to pay the processing fee within four weeks thereafter. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
