This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioner-accused of the private complaint case in C.C.No.8 of 2015 for the offence punishable under Section 138 of the Negotiable Instruments Act(for short, 'the N.I.Act'), maintained by the 2nd respondent/complainant on the file of the V Special Metropolitan Magistrate, Kukatpally, Hyderabad, praying to quash the proceedings in the above case.
2. Heard the learned counsel for the petitioner/accused so also the learned Public Prosecutor representing State-1st respondent before admission and perused the material on record.
3. The so called no proper service of statutory notice is left open to him to raise in the course of defence during the trial. From the difficulty expressed of his avocation would be effected by regular personal appearance throughout trial, the remedy is left open to him to file an application under Section 205 of Cr.P.C. to permit the special vakalath holder on his behalf to pass appropriate orders. In such an event, the learned Magistrate grant the same with necessary conditions including for personal appearance as and when required.
