THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13159 of 2015 ORDER:
The case of the petitioner is that he is the owner and possessor of land over an extent of Ac.1-30 cents in Survey Nos.41/8A, 41/7B and 41/8 of Vijalapuram Gram Panchayat, Ramakuppam mandal, Chittoor district by way of purchase through a registered sale deed document No.4480/2010 dated 15.12.2010. Out of the said land, an extent of Ac.0-50 cents in Survey No.41/7B a dairy shed was constructed with permission. Intending to convert the agricultural land for non-agricultural purposes, the petitioner filed an application dated 30.06.2014 before the 2nd respondent-Revenue Divisional Officer, Chittoor, under Section 3(2) of the Andhra Pradesh Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 (for short 'the Act') seeking permission and also paid requisite fee vide Challan No.3523. The grievance of the petitioner is that the 2nd respondent has not taken any action on his application till date.
2. The petitioner's counsel submits that as per proviso to sub-section (6) of Section 3 of the Act, if no order is passed on such request within the time stipulated therein, the required permission shall be deemed to have been given.
3. Learned Assistant Government Pleader, on the other hand, submits that he does not have objection for disposal of the writ petition, with a direction to the respondents to pass appropriate orders on the application said to have been submitted by the petitioner.
4. Recording the submission, the writ petition is disposed of, directing the 2nd respondent to dispose of the application dated 30.06.2014 submitted by the
petitioner, within a period of 15 days from the date of receipt of a copy of this order, in accordance with law. The petitioner is directed to place a copy of this order before the 2nd respondent and the same shall be construed as an intimation, to enable the 2nd respondent to proceed with and pass appropriate orders on the application submitted by the petitioner. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
