THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.2277 of 2015 ORDER:
Upon hearing both sides, at the admission stage, the following Order is passed:
It is seen that the private complaint filed by the complainant before XIX Metropolitan Magistrate, Kukatpally, Hyderabad District, was forwarded to the Police of Chandanagar, who registered a case in Crime No.70 of 2015 for the offences under Sections 120-B, 191, 192, 196, 200, 406, 420, 506 IPC and conducting investigation.
The allegations are that the petitioners/accused Nos. 1 and 2 offered to sell two plot Nos. 301 and 302 in the third floor of Nallagandla residential complex for a total consideration of Rs.30,00,000/- and on their inducement, the complainant paid them Rs.30,00,000/- and the accused have also collected another Rs.4,00,000/- from the complainant, but later they cheated him and sold two plots to 3rd parties. Having regard to the prima facie accusation contained in the FIR and as the investigation is in progress, it is not a fit case to quash the proceedings. Hence, the investigation shall be continued to its logical end. However, considering the request of the learned counsel for petitioners, the Police of Chandanagar, Cyderabad, are directed to strictly follow the procedure contemplated under Section 41-A Cr.P.C. during the course of investigation towards the petitioners/Accused Nos.1 and 2. The petitioners shall cooperate with the investigating agency for smooth completion of investigation.
Accordingly, the Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________ U.DURGA PRASAD RAO,J 02-04-2015
