HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.Nos.23976 & 37908 OF 2018 COMMON ORDER Since the issue involved in both the writ petitions is one and the same, they are heard together and being disposed of by way of this common order.

For the sake of convenience, the facts in W.P.No.23976 of 2018 are discussed hereunder.

The grievance of the petitioners is that they are having small shops adjacent to the RTC bus depot and the respondents are trying to interfere with their peaceful possession, without following due process of law. While admitting W.P.No.23976 of 2018, this Court granted status quo on 12.07.2018 in I.A.No.1 of 2018. Learned counsel appearing for the petitioners contended that appropriate orders be passed in the writ petition directing the respondents not to interfere with the peaceful possession of the petitioners.

Learned Standing Counsel appearing for the respondents filed counter-affidavit contending that the respondents have not interfered with the peaceful possession of the petitioners and in fact, the petitioners are trying to obstruct the way of the respondents.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that since the respondents have stated in their counter that they are not interfering with the peaceful possession of the petitioners, and that the petitioners are obstructing their way, both the writ petitions are disposed of directing the respondents not to interfere with the peaceful possession of the petitioners, without following the due process of law. However, it is made clear that the petitioners shall not obstruct the way meant for ingress and egress of the buses into the RTC Bus Depot. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
