THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4391 OF 2016 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the Petitioner - A4 seeking to quash the proceedings against him in CC.No.16 of 2015 on the file of Special Judge for SPE/ACB Cases, Nellore.

Heard and perused the material available on record. The offences alleged against the petitioner are punishable under Sections 7 & 13 (2) r/w.13(1) (1) (d) of the Prevention of Corruption Act.

After arguing for some time, learned counsel for the petitioner while not pressing for the main prayer, confined his arguments only to the extent of dispensing with the presence of the petitioner before the trial Court.

In view of the submission of the learned counsel for the petitioner, the presence of the petitioner before the trial Court is dispensed with except on the dates of framing of charges, if any, examination under Section 313 Cr.P.C., and also on the date of pronouncement of judgment and the petitioner shall be properly represented by his counsel before the trial Court on all hearing dates. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions filed in this Criminal Petition, if any, shall stand closed. ______________ RAJA ELANGO, J March 30, 2016.
