Heard.

The petitioners claim title to the lands in question through registered document. However, respondents 5 to 7 claiming right over the lands in question filed an appeal before the 3rd respondent and the said appeal was disposed of on 24-04-2015. In the said order, the appellate authority held that the pattadar pass books and title deeds issued to the petitioners is without following due procedure and without conducting any enquiry by the Tahsildar. He, therefore, cancelled the pattadar pass books and title deeds of the petitioners and directed the 4th respondent to conduct fresh enquiry and then issue pattadar pass books and title deeds in favour of rightful owner.

Aggrieved by the said order, the petitioner preferred a revision before the 2nd respondent herein on 21-05-2015 and neither the revision petition nor stay petition is being taken up and no orders are passed. Since the relief sought for by the petitioner is only limited with regard to consideration of the revision and the stay application, I deem it appropriate to dispose of the writ petition by directing the 2nd respondent to consider the petitioners revision atleast pass appropriate orders in the stay application filed by the petitioner expeditiously preferably within two weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 05-06-2015 Prv
