THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37912 of 2018 ORDER:

When the matter is taken up, written instructions dated 23.10.2018 furnished by the Sub-Inspector of Police, Gachibowli Police Station, Cyberabad Commissionerate, are placed on record by the learned Government Pleader for Home.

To the extent of their relevance to the present writ petition, the said instructions read as under:

"During the course of investigation, I have examined the complainant in Police Station and recorded her statement in detail in corporate in CD Part-II. She further stated that her legal money is with the accused persons. I visited the scene of offence and prepared crime details form in the presence of mediators. The complainant alleged that her digital signature was forged by her father in law with fraudulent intention to claim her income tax returns.

The complainant alleged that the A2 and A3 were used her digital signature and filed income tax returns illegally without any valid rights. The income tax returns from the petitioner account amounting 94940/- have also credited to SBI a/c No.10984024675 over a period of three years. This is a joint account but solely operated by the accused-2. Collection of documentary and technical evidence pending in this case. I have to visit Dharmapur SBI branch Maharashtra for collection of locker details which are important in this case. I will obtain permission from my superior officers to travel other state for the purpose of investigation. On 06.04.2018 I addressed a letter to

income tax department office situated at Nagpur for collecting details of the income tax returns of the PAN of the complainant which were alleged to be misused by her father in law. Most of the investigation part laid in other state. The other key witness Deshmukh who is a charted accountant who also residing at Nagpur Maharashtra. I will obtain permission from the superior officers and I will collect all the technical, digital and documentary evidence and proceed further in this case."

Taking into consideration the submissions of the learned counsel for the petitioner and the learned Government Pleader for Home and by placing on record the above said instructions, the writ petition is disposed of with a direction to the respondent police to complete the investigation and file final report as expeditiously as possible.
