THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.15797 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the first respondent in delaying the mutation of the petitioner's name in Gram Panchayat records for the schedule residential plot admeasuring 0.10 gts or equivalent to 1227.77 yards in Sy.No.6 including huts bearing H.No.3-35 & 3-36 situated at Jadi Jamalpur village, Bodhan Mandal, Nizamabad District as illegal and arbitrary.

It is the case of the petitioner that he submitted an application to the first respondent gram panchayat on 23.10.2013 to mutate his name in the Grampanchayat records as owner of house bearing No. 3-35 & 3-36 situated at Jadi Jamalpur village, Bodhan Mandal, Nizamabad District. For one reason or other, the first respondent did not dispose of the representation of the petitioner.

At the time of hearing, the only relief sought by the learned counsel for the petitioner is to direct the first respondent to dispose of the representation of the petitioner.

In view of the submission made by both the counsel, this Court is not inclined to go into the merits of the main case. 5.

Having regard to the facts and circumstances of the case, the first respondent is hereby directed to dispose of the representation of the petitioner dated 23.10.2013 in the light of the provisions

made under Telangana State Gram Panchayat Act and Rules made there under as expeditiously as possible.

With the above direction, the writ petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
