HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.38922 of 2016 ORDER:

The grievance of the petitioners is that the representation filed on 18.10.2016 for payment of compensation for acquiring petition schedule lands is not disposed of by respondent No.4-Special Deputy Collector (Land Acquisition).

Learned Assistant Government Pleader places on record the written instructions, dated 04.11.2016, received from respondent No.4. The relevant portion reads thus:

"It is submitted that the petition dated 18.10.2016 sent by the writ petitioners received in this office and action is being taken for verification of the title and extents of their land. It is submitted that the compensation will be paid to the D-Form patta land holders on par with the private lands as per the Land Acquisition R & R Act, 2013 (Central Act 30 of 2013). The D-Form patta holders list consisting of names of 12 D-Form pattadars for an extent of Acs.45.81 was communicated to the Tahsildar, Kunavaram vide Ref.SDT2/8/2016, dated 18.05.2016 for verification and to report so as to obtain permission for payment of compensation from the Special Collector (Land Acquisition). The names of nine writ petitioners also existing in the list. The nine writ petitioners covered by an extent of Acs.38.95 cents in the list. Remaining extent Acs.81.06 will be verified while submitting II Notification to be issued for an extent of Acs.60.14 of patta land at an early date.

It is further submitted the writ petitioner may be put to strict proof of the title over the lands to claim for payment of compensation. If there is any title dispute over the land, the same will be referred to the authority constituted under the Act 30/2013 for appropriation of compensation amount."

Having regard to the instructions, the writ petition is disposed of directing respondent No.4 to pass orders in accordance with law and facts of the case expeditiously. The petitioners are given liberty to prove their entitlement of lands claimed by them before respondent No.4.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. __________________ S.V.BHATT,J Dt:11.11.2016 kdl
