ORDER:
The inaction of respondent No.4 in disposing of Election O.P.No.56 of 2014 filed by the petitioner questioning the election of respondent No.3 as President of the Mandal Praja Parishad of Medipally is questioned in this Writ Petition. A perusal of the record shows that the petitioner has filed the above-mentioned Election O.P. on 01.8.2014 and respondent No.3 has filed a counter-affidavit more than one year later, i.e., on 13.8.2015. Be that as it may, if an Election O.P. is not disposed of within a reasonable time, the legislative intent in providing a remedy for the unsuccessful candidates to question the election will be frustrated. As more than one year had elapsed from the date of filing of the Election O.P., respondent No.4 is directed to dispose of the said Election O.P. within three months from the date of receipt of a copy of this order, if necessary by fixing a schedule for a day-to-day trial.
Subject to the above direction, the Writ Petition is allowed. As a sequel to disposal of the Writ Petition, W.P.M.P.No.47872 of 2015 shall stand disposed of as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 18th November, 2015 DR
