SHYAM PRASAD WRIT APPEAL No. 1381 of 2016 JUDGMENT: (Per VRS,J) Aggrieved by the refusal of the learned single Judge to grant an interim suspension of the orders withdrawing the in-charge arrangements given to them in a higher post, the writ petitioners have come up with the above writ appeal.

Heard Mr. N. Aswarth Narayana, learned counsel for the appellants.

The grievance of the appellants is that they were holding substantial posts of Work Inspectors (non-technical), and that for the past several years, they have been put in-charge of the Mandals and, consequently, designated as Assistant Engineers. But, by the orders impugned in the writ petition, namely, the orders, dated 17.11.2016, their in-charge arrangements have been withdrawn and regular Assistant Engineers have been posted to their place. 4.

Considering the nature of the grievance of the appellants, the learned Judge thought fit to order notice in the writ petition and did

VRS,J & GSP,J WA No.1381 of 2016 not grant any ex parte interim order. Aggrieved by the non-grant of an ex parte interim order, the appellants are before us. 5.

It is needless to state that no person acquires a vested right to continue to be in-charge of a higher post. The grant of in-charge arrangements does not confer any right upon anyone. Therefore, if the learned Judge thought fit not to exercise the discretion to grant an ex parte interim stay of withdrawal of such in-charge arrangements, the same is perfectly in order and cannot be interfered with. Hence, the Writ Appeal is dismissed.
