This writ petition is filed to declare the action of 4th respondent in issuing proceedings D.Dis(E4)/1773/2016, dated 02-07-2016 cancelling the D-form patta AM.No.8/4/1413 dated 26-09-2014 issued to the petitioner as illegal and arbitrary.

This Court passed interim orders on 22-07-2016 and the same was extended on 17-08-2016 and 24-08-2016. Now counter and vacate stay petition is filed. In the counter filed by the 5th respondent, it is averred that the petitioner has alternative remedy to challenge the impugned order. Apart from disputed factors including issuance of DKT patta, the impugned order goes to show that the petitioner was issued notice and explanation filed. The grievance of the petitioner is that no show-cause notice is issued. The petitioner has already filed appeal against the impugned order before the Commissioner of Appeals.

Without expressing any opinion on merits, the 2nd respondent-authority is directed to dispose of the appeal filed by the petitioner against the order passed on 02-07-2016 cancelling the D-Form patta within a period of eight (08) weeks from the date of receipt of a copy of this

order. Till disposal of appeal, interim stay granted on 22-07-2016 will continue. If the petitioner does not co-operate in disposing of the appeal, it is open for the appellate authority to dispose of the same in accordance with law.

Accordingly, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 07-09-2016 Nvl
