THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35594 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed aggrieved over the interference of the respondents, more particularly, respondents 6 to 8, and also the interference of the 3rd respondent under the guise that the petitioner is using the electrical poles without the permission of the 8th respondent.

It is the case of the petitioner that he is already using the poles after payment of tax as per the permission obtained from the concerned respondent and he also intend to use another 100 poles for the purpose of extending his business, for which he has already submitted an application to the Deputy Electrical Engineer, Bapatla, on 05.10.2016.

The main grievance of the petitioner is that when the employees of the petitioner company were laying OFC fiber cables at Chandole area, the 7th respondent obstructed their work and abused them to stop the fiber laying for the reason of not obtaining valid permission and that the employees of the petitioner company were taken to the 3rd respondent police station as the 3rd respondent has received complaint from the 8th respondent to provide protection to them from ACT as they are going to cut the cables placed by unauthorized usage of electrical poles. Learned Assistant Government Pleader submits that the 3rd respondent is nothing to do with the case and the 3rd respondent is not interfering with the affairs of the petitioner. He further submitted that no complaint is pending with the 3rd respondent.

Considering the rival submissions, the Writ Petition is disposed of with the following direction:

The Deputy Electrical Engineer, Bapatla, to whom the petitioner submitted his representation on 05.10.2016, is directed to consider the same and dispose of the same within a period of one (1) month from the date of receipt of a copy of this order. Until the disposal of the said representation, dated 05.10.2016, the respondents, more particularly, respondents 3 & 6 to 8 are directed not to interfere in the affairs of the petitioner.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J Date: 25th October, 2016.
