THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41595 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the inaction of the second respondent in granting legal protection to protect the household properties of the members of the petitioner association in survey No.710/1 to an extent of Acs.3.00 guntas situated at Sri Saibaba Nagar (Opposite to Bhavanarushi Society), Kapra Mandal, Medchal District (Old Ranga Reddy District) by taking action against the respondents 4 and 5 who are violating Court Orders held in favour of the petitioners is arbitrary and illegal, and consequently to direct the second respondent to grant police aid to the members of the petitioner association against the unofficial respondents. Heard and perused the material.

Learned counsel for the petitioners submits that when the revenue officials tried to dispossess the members of the petitioner association, the petitioner association filed a writ petition being W.P.No.35601 of 2016 and this Hon'ble Court passed an interim directions directing the revenue officials including the third respondent not to take any coercive steps against the petitioner association. He further submits that when the respondents 3 to 5 colluded together and are continuously trying to trespass into the lands of the members of the petitioner association, the petitioners herein filed a written complaint, dated 28.10.2016 seeking police aid to protect the lands of the members of the petitioner association as well as to take legal action against the respondents 4 and 5, but the second respondent is not taking any action on the representation of the petitioner association.

Considering the facts and circumstances of the case, the second respondent is directed to consider the representation dated 28.10.2016 submitted by the petitioner association and provide police protection to the individual household properties of the members of the petitioner association if the second respondent is of the view that there is any necessity to provide police protection.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 30.11.2016 pln
