This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the second respondent in not considering the petitioner for appointment as a Fair Price Shop Dealer of Shop No.14 of Kapati Village, Adoni Mandal, Kurnool District on compassionate grounds as per G.O.Ms.No.4, dated 28.02.2014 as illegal and arbitrary and consequently direct the respondents to consider the case of the petitioner for appointment as Fair Price Shop Dealer. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
The learned counsel for the petitioner submitted that the mother of the petitioner, who is a permanent Fair Price Shop Dealer of Shop No.14 of Kapati Village, Adoni Mandal, Kurnool District, died due to ill health on 25.07.2015. After her death, the petitioner filed representation on 01.12.2015 requesting the second and third respondents to appoint him as Fair Price Shop Dealer in the place of her mother on compassionate grounds. Admittedly, the respondents 2 and 3 have not passed any orders on the representation of the petitioner.
In view of the submission made by the learned counsel for the petitioner, the second respondent is hereby directed to dispose of the representation of the petitioner dated 01.12.2015 in the light of G.O.Ms.No.4 dated 28.02.2014 as early as possible, preferably, within a period of one month from the date of receipt of copy of this order.
With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
