HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.15127 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) The petitioner in the instant Habeas Corpus Petition seeks production of one G.Laxmi, 21 years old, and Johnson, 24 years old, who, according to the petitioner, are illegally detained by the respondents.
Respondent No.3 filed counter-affidavit stating that four criminal offences so far have been registered against G.Laxmi and Johnson, who are daughter and son-in-law of the petitioner, bearing Crime Nos.159 of 2011; 7 of 2013; 14 of 2013 and 44 of 2015 mainly for the offence punishable under Section 379 of IPC. In the counter-affidavit, it has also been categorically stated that on 02.06.2015, they were apprehended by Naidupet Police Station and presently they are in judicial custody.
In view of the statements made on affidavit, we find no merit in the writ petition. Hence, the writ petition is dismissed. It is open to the petitioner and/or G.Laxmi and Johnson to adopt appropriate remedy for their release on bail or for quashing of the crime, if they so desire and advised.
Consequently, miscellaneous petitions, if any, also stand disposed of.
