THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.4391 of 2015 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking issuance of a writ of mandamus declaring the inaction of the respondent authorities in taking appropriate steps pursuant to the representations dt.02.02.2015 and 05.02.2015 submitted by the petitioners and others for protecting and safeguarding the Grama Kantam Temple land admeasuring Ac.1.04 guntas in survey No.275 situated at Kesamudram Village and Mandal, Warangal District, from encroachment, as illegal, arbitrary and unjust and consequently direct the respondent authorities not to grant any permission to the 5th respondent.

Heard both sides.

Though various grounds are raised in the writ petition, the learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to consider the representation made by the petitioners, at the earliest.

Learned Government Pleader submits that the 3rd respondent may be directed to dispose of the representation of the petitioner made on 05.02.2015, if not already disposed of, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 3rd respondent to consider the representation dated 05.02.2015 submitted by the petitioner along

with other villagers and pass orders thereon, if not already passed of, in accordance with law, after giving an opportunity of hearing to R-5 herein, as early as possible, preferably within a period of eight weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
