THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11557 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

The case of the petitioner, as seen from the contents of the affidavit of the petitioner, is that he was appointed as fair price shop dealer vide proceedings No.240/2004-2005 in respect of F.P. Shop No.29 of Pentapadu Village and Mandal, West Godavari District, and his authorization was in force till 31.03.2016. While so, on 06.11.2015 the A.G., Vigilance and other staff members, raided the shop and found certain irregularities. Petitioner, being in-charge of F.P. Shop No.30 of Pentapadu, said F.P. shop was also inspected by the authorities. Alleging certain irregularities, a report dated 07.11.205 was sent to the 2nd respondent, who in turn, had issued a show cause notice dated 08.01.2016 and also suspended the authorization of the petitioner. It is further stated that the petitioner has submitted his explanation dated 01.02.2016.

It is the grievance of the petitioner that without completing the enquiry, the 2nd respondent is trying to issue notification to appoint new Fair Price Shop dealer. Hence, the present writ petition is filed. As the allegations leveled against the petitioner are serious in nature, the respondent-authorities are bound to conduct an enquiry against the petitioner by taking into consideration the explanation submitted by the petitioner.

In the light of the aforesaid discussion and inasmuch as the petitioner has already submitted his explanation denying the allegations made against him, the respondents-authorities are

directed to complete the enquiry and pass appropriate final orders within a period of four weeks from the date of receipt of a copy of this order duly affording an opportunity of hearing. Subject to the above, the writ petition is disposed of. No order as to costs.

In view of disposal of the main writ petition, miscellaneous petitions pending in the writ petition, if any, shall stand closed. _______________________ Challa Kodanda Ram, J 11th April, 2016.
