HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.C.M.P.No.645 of 2015 ORDER:

This petition is filed to withdraw H.M.O.P.No.386 of 2015 from the file of Family court, Vijayawada, Krishna District and transfer the same to Family court, Visakhapatnam.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 18.10.2013 at Sri Lakshmi Function Hall, Baji Junction, Visakhapatnam, as per Hindu rites and caste custom. She stated that she filed Family Court O.P.NO.1318 of 2015 for restitution of conjugal rights and respondent filed H.M.O.P.No.386 of 2015 before Family Court, Vijayawada.

She stated that respondent is employed in a Nationalized Bank and petitioner is dependant on her parents and it is difficult for her to travel from Visakhapatnam to Vijayawada to defend divorce case filed by respondent. For that reasons, she prayed for transfer of O.P. from Vijayawada to Visakhapatnam. 3.

Respondent did not file any counter disputing the affidavit averments of petitioner.

4. Heard both sides.

5. Advocate for respondent submitted respondent has no objection for transfer, but sometime may be fixed for early disposal of OP.

6. Considering the submissions of both sides and also considering the convenience of wife, H.M.O.P.No.386 of 2015 is withdrawn from the file of Family court, Vijayawada, Krishna

District and transferred to Family Court, Visakhapatnam for disposal in accordance with law. Family Court, Visakhapatnam shall dispose of the said O.P., as expeditiously, as possible, preferably, within six (06) months from the date of receipt of records.

7. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. Miscellaneous Petitions, pending in this petition, if any, shall stand closed.
