HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24756 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the second respondent in proceeding to initiate coercive steps against the petitioner under Letter No.CEIG/AO/Duty/ED2/RJY/D.No.1166/2016 dated 20.06.2016 for recovery of disputed amount of electricity duty for the period 17.07.2003 to 23.05.2013 as per the orders of this Court in W.P.No.6095 of 2004 and batch dated 19.05.2016 even before the period of limitation for filing a Special Leave Petition before the Apex Court has expired as arbitrary and unreasonable and consequently direct the second respondent not to proceed in furtherance to the impugned letter dated 20.06.2016 in the circumstances above.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the writ petition.

Permission is accorded.

Accordingly, the writ petition is dismissed as withdrawn. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
