The case of the petitioner is that he is the creditor of respondent No.7 along with 51 creditors in IP.No.10 of 2018 on the file of Senior Civil Judge's Court, Kovur. The respondents 4 and 5 are trying to register and mutate revenue records without following any procedure and without prior notice to aggrieved parties of the schedule property in Sy.No.1549 of Atmakur Village to an extent of Ac.1-89 cents situated at Atmakur Village, SPSR Nellore District in collusion with respondents 6 and 7. Hence, the petitioner filed writ petition seeking stay of further proceedings of alienation and mutation of schedule property belongs to the 7th respondent. Admittedly IP.No.10 of 2018 filed by the 7th respondent is pending. As on today the rights of the petitioner is not decided and learned counsel for the petitioner has not brought to my notice any provision of law for grant of relief in the writ petition. In view of the same, I am not inclined to entertain the writ petition.
Accordingly, this writ petition is disposed of granting liberty to the petitioner to avail alternative remedies available to him under law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. No order as to costs. _________________________ A.RAJASHEKER REDDY,J 22-10-2018 Nvl
