THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.16275 OF 2016 ORDER:

This petition is filed under Section 482 Cr.P.C. challenging the order, dated 13-10-2016 in Crl.M.P.No.5569 of 2016 in C.C.No.449 of 2015 on the file of the II Additional Judicial Magistrate of I Class, Rajahmundry, East Godavari District.

Heard the learned counsel for the petitioners. 3.

A perusal of the record reveals that the trial Court recalled N.B.W issued against the petitioners on a condition of their executing a bond for Rs.10,000/- with two sureties for a like sum each by the next date of hearing i.e., 07-11-2016 as a condition precedent, failing which, the petition stands dismissed without any further order from the Court.

Learned counsel for the petitioners submitted that the trial Court extended the time for execution of bond with two sureties. He further submitted that the petitioners are facing much difficulty to secure two sureties, each for Rs.10,000/-. 5.

Taking into consideration the facts and circumstances of the case, I am of the considered view that it is a fit case to modify the order of the trial Court.

Accordingly, the Criminal Petition is disposed of directing the petitioners to execute a bond for a sum of Rs.5,000/- each with two sureties for a like sum each (instead of Rs.10,000/- with two sureties each) on or before 15-12-2016 and till such time, the trial Court is directed not to execute N.B.Ws. against the petitioners. Miscellaneous petitions, if any pending, in this Criminal Petition shall stand closed.
