THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.11477 of 2015 ORDER:

The petitioner challenges the order dated 13-03-2015 passed by the Additional Agent to Government and Project Officer, ITDA, Adilabad, the 2nd respondent herein, in exercise of powers conferred under the Agency Rules, 1959. A perusal of the order reveals that the 4th respondent herein filed appeal before the 2nd respondent against the order dated 10-02-2015, passed by the Special Deputy Collector (TW), Utnoor, the 3rd respondent. While admitting the appeal, the 2nd respondent has granted ad interim stay as prayed for, in favour of the 4th respondent through order dated 1303-2015. The same is challenged in this writ petition. It is not the case of the petitioner that the appellate authority lacks jurisdiction to grant stay. This being an ad interim order, there is no cause of action for the petitioner to file a writ petition, and there is no valid reason for this Court to entertain the writ petition.

The writ petition is accordingly disposed of, with a liberty to the petitioner to approach the appellate authority, the 2nd respondent herein, by filing a vacate petition, for setting out his grievance, either for vacating or modifying the order.

As and when such an application is filed, the same shall be considered and

disposed of in accordance with law, either by passing final orders in the appeal or in the vacate petition, within a period of eight weeks, thereafter. The miscellaneous petition filed in the writ petition shall also stand disposed of. There shall be no order as to costs.
