ORDER:

This writ petition is filed for the following substantive relief: "... to issue writ, order or direction preferably writ of mandamus, declaring the action of the 3rd respondent municipality in not handing over the shop No.98 namely 'Kotni Gurumurthy Complex' situated at Kasibugga, Srikakulam District, even though the petitioner was the successful bidder in the auction conducted on 24.08.2007 and 25.08.2007 and allotting the

said shop in favour of the 4th respondent is illegal, arbitrary, contrary to record and violative of principles of natural justice and consequently direct the 3rd respondent municipality to handover the said shop in favour of the petitioner." At the hearing, Mr. M.M.M. Srinivasa Rao, learned counsel representing Mr. Kowturu Vinayakumar, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to file a comprehensive writ petition by adding the relief of setting aside the allotment made to respondent No.4.

The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the writ petition, W.P.M.P. No.44878 of 2015 shall stand disposed of as infructuous.
