THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION NO. 34374 OF 2013 ORDER:

This writ petition is filed by the wife of the workman in whose favour an award was passed by the Industrial Tribunal on 25.06.2005 in I.D.No.31 of 2004. Today, by a separate judgment, W.P.No.23994 of 2006 filed by the Depot Manager challenging the correctness and validity of the award in I.D.No.31 of 2004 has been dismissed. Because of the pendency of the said writ petition, the Depot Manager has not settled the terminal benefits payable to the workman. During the pendency of that writ petition, the workman died. Hence, the present writ petitioner in this case got impleaded as third respondent and prosecuted the case on behalf of the deceased workman.

The only objection raised by Sri Vasudeva Reddy, learned Standing Counsel for APSRTC is that, when the Corporation itself has challenged the correctness and validity of the award, the petitioner herein could not have expected the Corporation to settle the terminal benefits when the adjudication in W.P.No.23994 of 2006 being finalized.

The objection raised by the learned Standing Counsel is no longer valid, inasmuch as, the writ petition preferred by the Depot Manager, A.P.S.R.T.C, Sanga Reddy Depot, Medak District against the award passed on 25.06.2005 in I.D.No.31 of 2004 by the Industrial Tribunal-II, Hyderabad, having been dismissed today, it is only appropriate that the terminal benefits payable on the count of the husband of the writ petitioner herein who was the actual workman shall be settled as expeditiously as possible, preferably within a maximum period of two months from the date of receipt of this order.

Writ petition stands disposed of with this order. Consequently, miscellaneous applications pending shall also stand closed. No costs.
