HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3713 of 2015 ORDER :

The Petition is filed by the Petitioners-A.1 to A.3 under Section 482 Cr.P.C to quash the proceedings in C.C.No.1045 of 2013 on the file of the learned II Additional Chief Metropolitan Magistrate, Vijayawada.

2) Both the parties present and sought permission to compound the offences punishable under Sections 498-A, 406,420 I.P.C. and Sections 3 and 4 of Dowry Prohibition Act(for short, 'the D.P. Act'), stating that they live together amicably.

3) Accordingly, permission is accorded to compromise in the above case to subserve the ends of justice from the parties needs to compromise, even though Sections 3 and 4 of the D.P.Act are not compoundable since main offences under Sections 498-A, 420 and 406 of I.P.C. are compoundable with the permission of the Court. In the interest of justice this Court permitted by invoking Section 482 Cr.P.C to compound all the offences in the above crime and accordingly the offences are compounded in terms of their compromise.

4) Accordingly, the petition is allowed and all the proceedings in C.C.No.1045 of 2013 on the file of the learned II Additional Chief Metropolitan Magistrate, Vijayawada are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.

5) Miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
