O R D E R

The case of the petitioner is that he made an application dated 03.10.2013 before the 2nd respondent for grant of NOC in respect of the land admeasuring Ac.10-00 in Sy.No.266 of Chintagurthi Village, Khammam District as per G.O.Ms.No.307 Revenue (Assignments-1) Department dated 06.06.2013. As per the directions of the 2nd respondent, the 3rd respondent submitted a reported dated 29.10.2014 showing the value of the land as Rs.4 lakhs per acre as per the certificate of Sub-Registrar, Khammam Rural and requested for grant of NOC. In pursuance of the same, the 2nd respondent issued impugned order dated 30.11.2015 stating value of property is more than Rs.50 lakhs, as such proposals are to be submitted to Chief Commissioner of Land Administration as per clause 6 (iii) of Rc.E3/1584/13 dated 28.11.2015.

Thereafter, petitioner made another representation dated 16.06.2016 to 2nd respondent. As no orders are passed, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Since the petitioner's application dated 16.06.2016 is pending before the 2nd respondent, the 2nd respondent is directed to consider the same in terms of clause 6 (iii) of Rc.E3/1584/13 dated 28.11.2015 since it is stated that Chief

Commissioner of Land Administration is the authority for scrutinizing the proposal where the value of land is more than Rs.50 lakhs and pass appropriate orders in accordance with law within a period of six (06) weeks from the date of receipt of copy of this order and thereafter Chief Commissioner of Land Administration is to take appropriate action in accordance with law.

With the above direction, writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY,J Date: 15.09.2016 dv
