Potu Syamala v. The State Of Telangna
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.18970 OF 2015 Date:26.06.2015 Between:
Potu Syamala .. Petitioner And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat Buildings, Hyderabad and others .. Respondents
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.18970 OF 2015 ORDER:
Heard.
The petitioner herein was aggrieved by the order of the Revenue Divisional Officer, Mulugu Division, Warangal Dsitrict, the 3rd respondent, dated 15.06.2015, whereby the pattadar passbook and title deeds issued in his favour for an extent of Ac.1.35 guntas in Survey No.50/A, Ac.0.08 guntas in Survey No.32 at Jaggannapet Village, Mulugu Mandal, Warangal District, were cancelled and the name of the petitioner was directed to be deleted from the pahanies. Therefore, the petitioner preferred a revision before the Joint Collector and Revisional Authority, the 2nd respondent, on 20.06.2015 along with a stay petition.
It is stated by the learned counsel for the petitioner that the 2nd respondent has ordered notice and in the meanwhile the petitioner apprehends that if the interim order is not passed, on the basis of the order passed by the 3rd respondent, all the entries in the revenue records would be directed to be deleted from the pahanies and the name of the 5th respondent be restored and hence, he seeks interim protection besides the revision petition. Learned counsel also states that the revision is now posted to 21.07.
interim protection, all the entries in the revenue records would be reversed.
I find prima facie that the entries in favour of the petitioner in the revenue records exist for about 20 years and she is entitled to an opportunity before the revisional authority to substantiate her claim and in the meanwhile, the implementation of the order of the 3rd respondent even before the said revision petition is heard by the 2nd respondent would cause prejudice to the petitioner.
Hence, the Writ Petition is disposed of at the stage of admission directing that the order of the 3rd respondent, which is impugned in this Writ Petition, shall not be implemented pending further orders to be passed by the revisional authority, the 2nd respondent, when the revision petition is scheduled to come up for hearing before the authority on 21.07.2015. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
