THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37162 of 2015 ORDER:
The grievance of the petitioner was as to the alleged inaction of the Station House Officer, Cyber Crime Police Station, Hyderabad, upon its complaint dated 07.10.2015.
Written instructions dated 28.11.2015 were furnished by the Inspector of Police, Cyber Crime Police Station, CCS, DD, Hyderabad, to the office of the learned Government Pleader for Home, wherein it was stated that upon examination of the petitioner's complaint it was found that the offence alleged was a noncognizable one and accordingly an entry was made to that effect in the relevant diary and the petitioner was informed on 23.11.2015 by registered post. It appears that the Inspector of Police, Cyber Crime Police Station also filed a petition before the competent criminal Court seeking permission to register a case under Section 506 I.P.C.
However, it appears that the learned XII Additional Chief Metropolitan Magistrate, Hyderabad, endorsed on the petition filed by the police authorities to the effect that the contents of the complaint did not demonstrate that an offence under Section 506 I.P.C. was made out and accordingly returned the same. In the light of the aforestated developments, as the provisions of Section 155 Cr.P.C. have been duly complied with, this Court finds no reason to interfere in the matter. It shall however be open to the petitioner to work out its remedies in accordance with law.
The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
