HON'BLE SRI JUSTICE R. SUBHASH REDDY CIVIL REVISION PETITION No.5314 of 2015 ORDER :

This civil revision petition is filed by respondent No.2 in O.P.No.331 of 2012, aggrieved by the order dated 20.09.2015, passed by the XIII-Additional Chief Judge, City Civil Court, Hyderabad, in I.A.No.457 of 2015.

The above O.P. is filed by the wife of deceased, claiming compensation under Motor Vehicles Act. The present application in I.A.No.457 of 2015 is filed to amend the provision of law from Section 166 to Section 163A of the Motor Vehicles Act, 1988. The said petition is allowed.

Mainly, it is the case of revision petitioner that the said application is filed at a belated stage. However, it is to be noticed that the provision of law itself cannot be the basis for award of compensation if the victim is otherwise entitled for such compensation. Having regard to the provisions for grant of compensation, the Act is a beneficial legislation to the victims of motor vehicle accidents.

For the aforesaid reasons, I do not find merit in this revision, so as to interfere with the impugned order. The revision is accordingly dismissed. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
