HON'BLE SRI JUSTICE S.V.BHATT W.P. No.36013 OF 2016 ORDER:

Heard Ms.Lakshmi Priyanvita Popuri for petitioner and the Assistant Government Pleader.

The petitioner, a dealer in fertilizer, challenges the interim order dated 03.09.2016 whereunder the 2nd respondent directed disposal of seized fertilizers pending enquiry and final orders under Section 6A of the Essential Commodities Act, 1955. The petitioner is aggrieved by the order dated 03.09.2016. Hence, the writ petition. The petitioner has filed petition for appropriate orders including release of stocks seized under Panchanama dated 23.08.2016. The further grievance of the petitioner is that pending consideration of the prayer of petitioner for release of stocks, if the direction given in the order dated 03.09.2016 is carried out, the petitioner suffers irreparable loss, hardship and injury. I have heard the Assistant Government Pleader. I am satisfied that the writ petition can be ordered as follows:

1) The petitioner is given liberty to resubmit the copy of Ex.P.1 filed along with the writ petition by enclosing a copy of this order within one week from today.

2) The 2nd respondent is directed to consider the petition and pass appropriate orders in accordance with law within a further period of four weeks.

Till a decision, as directed above, is taken and communicated, the order directing interim disposal of seized stock, is stayed.

The writ petition is ordered accordingly. No order as to costs.
