HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO COMPANY APPLICATION No.1 of 2017 IN COMPANY PETITION No.197 of 2015 ORDER:

This Company Petition is filed, under Sections 433(e), 434(1)(a) and 439 of the Companies Act, seeking winding up of the respondent - Company.

When the matter is pending, the petitioner and respondent entered into a settlement agreement. As per the terms of settlement, the petitioner - firm had to furnish proof of withdrawal of the petition, and the amount due from the respondent would be paid within thirty days from the date of Settlement Agreement. In case of failure to adhere to the terms of settlement, the petitioner was given liberty to revive C.P.No.197 of 2015 in terms of settlement.

C.A.No.1 of 2017 was filed for withdrawal of the company petition. In view of the same, C.A.No.1 of 2007 is allowed and the petitioner is permitted to withdraw C.P.No.197 of 2015.

Company Petition is, accordingly, dismissed as withdrawn.
