HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37987 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents 2 to 7 in not passing any orders on the representations dated 25.1.2016, 22.8.2016, 19.9.2017 and 1.2.2018, submitted by the petitioners seeking cancellation of building permission and approved plan accorded to the respondents 8 to 11 for land in Sy.No.29 and for prevention of illegal encroachment and construction insy.No.30 instead of Sy.No.29 being undertaken by them in the petitioners' open land admeasuring Ac.0.37 cents, situated at Sy.No.30, situated at Gopalpur Village, Hanumakonda Mandal, Warangal District, as illegal and arbitrary.
Though various grounds are raised, learned counsel for the petitioners submits that a direction may be given to the respondents 2 to 7 to deal with the representations submitted by the petitioners seeking cancellation of building permission and approved plan accorded to the respondents 8 to 11 for construction of a building in the subject lands and dispose of the same, in accordance with law. Smt P. Lakshmi, learned Standing Counsel for the Warangal Municipality, would submit that if the representations of the petitioners are still pending consideration, a direction may be given to the 2nd respondent to deal with the same and pass appropriate orders, in accordance with law.
Having regard to the above, without going into the merits of the case, the writ petition is disposed of directing the 2nd respondentMunicipal Commissioner, to deal with the representation dated 1.2.2018, submitted by the petitioners seeking cancellation of building permission and approved plan, accorded to respondents 8 to 11, for construction a building in the subject land and pass appropriate orders, in accordance with law as early as possible, preferably within a period of four to six
weeks from the date of receipt of copy of this order, after giving reasonable opportunity of hearing to the petitioners and all concerned. However, if the representation of the petitioners is not available in the office of the 2nd respondent-Commissioner, the petitioners shall file a fresh representation expressing their grievance. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
