ORDER

This Criminal Petition is filed seeking to enlarge the petitioner on bail, who is arrayed as an accused in S.C. POCSO No. 15 of 2022 on the file of the Fast Track Special Judge for Trial and Disposal of Rape and POCSO Act Cases,

Ranga Reddy District at L.B. Nagar. The petitioner has been in judicial custody since 14.08.2025 pursuant to the execution of a Non-Bailable Warrant (NBW).

Heard Sri Pamu Sudarshan, learned counsel appearing on behalf of the petitioner, and Sri E. Ganesh, learned Assistant Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner had filed a bail application before the trial Court, which was dismissed on the ground that the trial had been prolonged since 2022 due to the petitioner. However, he submitted that all the witnesses have been examined except the Investigating Officer. Therefore, he prayed the Court to grant bail to the petitioner by allowing the Criminal Petition. 4.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, stating that there are serious allegations against the petitioner and that the trial is at the fag end. He contended that if bail is granted at this stage, there is every likelihood of the petitioner absconding from the trial.

Therefore, he prayed the Court to dismiss the Criminal Petition. However, he informed the Court that the case is posted for the evidence of L.W.18, the Investigating Officer, on 02.03.2026.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it appears that the petitioner has been in judicial custody since 14.08.2025. As seen from the record, the trial is almost completed, except for the evidence of L.W.18. Considering the facts and circumstances of the case and the progress in the trial, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned FTC POCSO Court at Ranga Reddy District at L.B. Nagar.

ii.

The petitioner shall co-operate with the trial for the early disposal of the case.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
