This criminal petition is filed by the petitioner - accused No.2, under sections 437 and 439 Cr.P.C., seeking bail in Crime No.46 of 201516 on the file of Narsipatnam Prohibition & Excise Station, Visakhapatnam District, registered for the offences punishable under Section 8(c) read with Section 20(b)(ii) C of NDPS Act. The earlier bail application filed by the petitioner - accused No.2 was dismissed by this Court. Even though charge-sheet was filed, as the quantity of ganja recovered from the petitioner is commercial quantity, this Court is not inclined to grant bail to the petitioner - accused No.2.
