This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.3 seeking bail in crime No.367 of 2015 on the file of the III Town Police Station, Rajahmundry, registered for the offence under Sections 366-A, 370, 370-A, 372, 373, 376-D IPC and Section 6 of the Protection of Children from Sexual Offences Act and Sections 5 and 6 of the Immoral Traffic (Prevention) Act read with Section 34 IPC.
Heard and perused.
The case of the prosecution is as follows.
On 11.08.2015 at about 8.00 p.m., when victim girl reached near Panasachettu centre, A.1 to A.3 and A.4, who is auto driver, forcibly kidnapped and put into their auto and took her to A.1 house situated at Chowdeswarnagar, Rajahmundry, and kept her in a room. In that room, already two girls by name Sireesha and Neelima are there at A.1's house. On 12.08.2015 at 7.00 a.m., A.1 to A.4 took the victim girl and both Neelima and Sireesha to Bhimavaram and sold them for the purpose of prostitution to A.7 and A.8, who is mother of A.7, who maintains brothel at Bhimavaram and took money from them, A.7 A.8 made forcibly conducted prostitution and seduced to illicit intercourse with others for money, with the victim girl for ten days at their house/brother at Bhimavaram. Learned counsel for the petitioner submits that the petitioner is friend of A.
3 and he has nothing to do with the alleged offence. He prays this Court to grant bail to the petitioner herein. Though the learned counsel submits that A.
house and that the victim girl was subjected to sexual assault. Considering the facts and circumstances, this Court is not inclined to grant bail to the petitioner herein.
