I.A.No.2 of 2019 For the reasons stated in the affidavit filed in support of the application, the delay of 228 days in filing the review application, is condoned.

Rev.I.A.No.3 of 2019 This review application is filed seeking to review the order dated 12.04.2018 passed in LAAS No.51 of 2018.

Heard learned Government Pleader for Appeals appearing for the review petitioner.

Learned Government Pleader had contended that the Reference Court had erroneously granted 12.5% additional market value, which is contrary to the Statute, and the

Statue contemplates only 12% additional market value. Aggrieved by the order dated 21.04.2017 passed in O.P.No.69 of 2003 by the Reference Court, the State has preferred Appeal. Without appreciating the said fact, this Court had dismissed the appeal vide judgment dated 12.04.2018. Therefore, appropriate orders be passed by clarifying as to whether 12% additional market value can be granted as per the Statute.

Having considered the said submissions, this Court is of the view that as per the Statute, 12% additional market value shall be granted. Hence, the order dated 21.04.2017 passed in O.P.No.69 of 2003 by the Reference Court is modified and the additional market value at 12.5% awarded by the Reference Court is reduced to 12%.

Accordingly, the Review Application is ordered.
