Md. Ghulam Yazdhani and others ...Appellants and The Appellate Authority under Payment of Gratuity Act, 1972 and Deputy Chief Labour Commissioner and others

...Respondents

Counsel for the appellants : Mr. P. V. Krishnaiah Counsel for the respondents: Mr. K. Lakshman & Mr. G. Vidya Sagar, Senior Counsel for Ms. K. Udaya Sri The Court made the following:

HACJ&Dr.SA,J W.A.No.1439 of 2018 JUDGMENT: (Per the Hon'ble the Acting Chief Justice Raghvendra Singh Chauhan) The appellants have challenged the interim stay order dated 01.05.2018 passed by a learned Single Judge in I.A.No.1 of 2018 in W.P.No.15840 of 2018, whereby the order dated 10.11.2017 passed by the Controlling Authority under the Payment of Gratuity Act, 1972 and the order confirmed by the Appellate Authority under the Payment of Gratuity Act, 1972, by order dated 16.04.2018, were stayed by the learned Single Judge.

Since one year has gone by, after passing of the impugned order, this Court is of the opinion that the controversy should be decided by the learned Single Judge as expeditiously as possible. Considering the fact that the payment of gratuity has been stayed by the learned Single Judge, considering the fact that the continuation of the stay order creates financial difficulties for the appellants, this Court requests the learned Single Judge to finally decide the writ petition within a period of two months from the date of filing of the certified copy of this order.

With these directions, the Writ Appeal stands disposed of. There shall be no order as to costs.

The miscellaneous petitions pending, if any, shall stand closed. _______________________________ (RAGHVENDRA SINGH CHAUHAN, ACJ) _______________________ (DR. SHAMEEM AKTHER, J) 11th June, 2019 JSU
