THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11091 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.1, for grant of anticipatory bail in the event of his arrest in Crime No.1399 of 2018 of Rajendranagar Police Station, Ranga Reddy District, registered for the offences punishable under Sections 420, 468 and 471 I.P.C.

Heard the learned counsel for the petitioner/accused No.1, the learned Additional Public Prosecutor representing the respondent/State and perused the record.

Learned counsel for the petitioner/accused No.1 would contend that the petitioner/accused No.1 is innocent and falsely implicated in the above crime and prayed to allow this application. 4.

On the other hand, the learned Additional Public Prosecutor opposed the grant of anticipatory bail to the petitioner/accused No.1 and ultimately, prayed to dismiss this application. 5.

The specific allegation against the petitioner/accused No.1 is that he was the Ex-Correspondent/Principal of Asha School, Golkonda and that school had been shut down; thereafter, he started issuing false and bogus certificates to the persons to obtain driving license from the authorities of the Regional Transport Authority. In the instant case, the de facto complainant was handed over a Transfer Certificate and a Bona fide Certificate for the study which he has not pursued. Thereafter, he lodged a

report to the police. In the investigation, it has come to light that the petitioner/accused No.1 is involved in issuing bogus and false certificates after closure of the Asha School, Golkonda without there being any study and record. The allegations are specific and grave. Hence, it is not a fit case to allow this application under Section 438 of Cr.P.C.

Accordingly, the Criminal Petition is dismissed. 7.

Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
