HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.38029 of 2018 ORDER:

This writ petition is filed challenging the action of respondents 1 to 6 in not conducting the survey and fix the boundaries in respect of plot Nos 112, 113, 114, 119 and 120 admeasuring 200 square yards total admeasuring Ac.1200 square yards or 1003.2 square meters situated at Dundigal village and grampanchayat, Quthbullapur Mandal, Ranga Reddy District and consequential direction to respondent No.6 to stop the construction work of respondents 7 and 8. A perusal of affidavit and contention of learned Assistant Government Pleader for Revenue goes to show that a civil dispute is pending between the petitioner unofficial respondents and the petitioner instituted suit and he sought for appointment of advocate commissioner. Now, the petitioner is seeking direction to 6th respondent to stop the construction work of respondents 7 and 8.

It is not the case of the petitioner that official respondents are obstructing and interfering with their possession. When there is dispute between the private parties, no direction can be given to official respondents unless they interfere with the civil disputes. In view of the same, this Court is not inclined to entertain the writ petition and accordingly the same is disposed of. However, it is open for the petitioner to pursue alternative remedies available to him.

There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
