THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 6367 OF 2013 ORDER:

This Writ Petition is filed to declare proceedings No. 565/11-G1 dated 10-03-2011 of respondent No. 1 to the extent of allotment of Ac. 0.20 cents of layout open space at Mangaldas Nagar, Guntur, as illegal and arbitrary.

The subject land was initially allotted for construction of Urban Health Centre Community Hall but without cancelling the same, the said land again has been allotted for construction of 33/11 K.V. Substation by the impugned proceedings. 3.

When the matter came up for hearing, learned counsel for the petitioner submits that as on today, no construction has been taken place in the subject site.

In view of the same, the petitioner is given liberty to file fresh representation to respondent No. 1 ventilating its grievance within a period of two weeks from the date of receipt of a copy of this order and if any such representation is made, the latter is directed to consider the same and pass appropriate orders in accordance with law within a period of eight weeks thereafter. 5.

The Writ Petition is disposed of accordingly. Pending miscellaneous petitions, if any, shall stand closed in consequence.
