Dayyala Rajaiah, v. The Government Of Telangana, Rep. By Its Principal

2019-12-23P.Keshava Rao1 pages

HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.31092 of 2014 ORDER:

There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue an appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in not registering the case on petitioner's complaint dated 06.08.2014 as illegal, arbitrary and violation of principles of natural justice and consequently to direct the respondents to register the case basing on petitioner's complaint dated 06.08.2014."

Learned Government Pleader appearing for the respondents placed on record written instructions dated 20.12.2019 issued by the Head Constable, Karimnagar II Town Police Station, Karimnagar District.

From a perusal of the said written instructions, it is revealed that the petitioner has not given any complaint to respondent No.3 on 06.08.2014. Even on verification of the station records, there is no such complaint lodged by the petitioner. It is further mentioned in the written instructions that if the petitioner approaches the 3rd respondent and lodges a complaint, action will be initiated as per law.

In that view of the matter, this Court is of the opinion that no cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed. No costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 23.12.2019.
