Petitioner No.1 is the owner and possessor of house bearing No.2-1/1 (old) 2-1-17 (new), having acquired the same from his mother by way of gift settlement deed, dated 18.10.1996. Petitioner No.2 is the absolute owner and possessor of house bearing No.2-1/A/A (2-1-16). The said properties are situated at Jammikunta Village and Mandal, Karimnagar District.
It is the case of the petitioners that on 18.03.2015, the then Commissioner, Nagara Panchayat, Jammikunta, Karimnagar District issued certificate declaring that they are the owners of the said properties. They further state that respondent No.2 herein is proposing to widen the existing road from 80 feet to 100 feet and trying to demolish the properties of the petitioners without following due process of law. In those circumstances, the present writ petition is filed.
Learned Standing Counsel for respondent No.2 submits that if the petitioners do not express their consent, no action would be taken, without following due process of law.
In view of the said statement, the writ petition is disposed of directing respondent Nos.2 to 5 to follow due process of law in the
event of acquiring any part of the properties of the petitioners for the purpose of road widening or for any other public purpose. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:22.12.2016 kdl
