THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12081 of 2015 ORDER :
According to the petitioner he was entrusted with the work of construction of houses (G+3) at Chilkoor-II, Ranga Reddy District under JNNURM vide an agreement dated 18.11.2008 by the Greater Hyderabad Municipal Corporation. The approximate value of the work was Rs.7,96,16,511/-. The work was completed in all respects as per the specifications. However so far no final bill is paid and on account of inordinate delay in making the final payment, grave injustice is caused to the petitioner and the petitioner is forced to engage a watch man to take care of the properties. There is no dispute regarding the nature of execution of work and without any justification, the final amount is not paid. Aggrieved by the inordinate delay in
making payment, the petitioner submitted representations on 22.07.2014 and 28.10.2014 for settlement of final bill. But so far no orders are passed.
2. When the matter is taken up for consideration, learned counsel representing the respondents requests for disposal of the writ petition directing the authority to consider the representations and pass orders on the said representations.
3. Having regard to the same, the Writ Petition is disposed of directing the 2nd respondent to consider the representations submitted by the petitioner on 22.07.2014 and 28.10.2014 with reference to his claim for payment of final bill and pass orders as warranted by law within a period of three (3) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
4. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
