HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.10500 of 2015 O R D E R :

The petitioner who is accused No.1 in Crime No.388 of 2012 of IV Town Police Station, Visakhapatnam, registered for the offences punishable under Section 498A I.P.C. and Sections 3 & 4 of Dowry Prohibition Act, filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

When the matter is taken up for hearing, the learned Public Prosecutor informed that the investigation is completed and N.B.Ws. are also pending against the petitioner Considering the facts and circumstances of the case, the petitioner-accused No.1 is directed to surrender before the Court where the charge-sheet is pending and file petition to recall N.B.Ws. issued against him. Upon filing of such petition, the trial Court is directed to recall the warrant, pending against the petitioner, on the same day on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner-accused No.1 is directed to appear before the trial Court on all hearing days without fail.

With the above observation, the Criminal Petition is disposed of.
